Service Terms and Conditions of Use — Mili-Maus
These terms govern the homework-support service provided by Mélanie Afonso and your use of the Mili-Maus platform (website, web application and mobile app) to manage that service. By using the Mili-Maus family space, you accept these terms.
These terms are available in French, English and Portuguese. If the language versions differ, the French version prevails.
1. The Provider
1.1 Identity. Mélanie Afonso, independent homework-support provider, 1 Rue Joseph Müller, L-3651 Kayl, Luxembourg. Email: info@mili-maus.lu. Phone: +352 691 588 314. VAT exempt under Article 56bis of the Luxembourg VAT Act.
1.2 The platform. The Mili-Maus platform is operated by Luxxow S.à r.l.-S, RCS Luxembourg B311306, 12 rue Treeschheck, 3321 Berchem, Luxembourg, on behalf of Mélanie Afonso.
2. The Service
2.1 Description. Mili-Maus provides homework support (aide aux devoirs) for children. Sessions take place at the provider's premises in Kayl or at a location agreed with the family.
2.2 The platform. The Mili-Maus family space (web application and mobile app) allows you to view your children's sessions, report absences, request extra places, communicate with the provider, book meetings and view invoices. The platform is a management tool for the in-person service; it is not the service itself. Temporary unavailability of the platform does not affect sessions that take place in person.
2.3 Service hours. Sessions are held during the hours communicated to you by the provider.
3. Accounts
3.1 Invitation only. Accounts are created by invitation from the provider. You cannot create an account yourself.
3.2 One account per guardian. Each parent or legal guardian receives a personal account with an email address and password.
3.3 Account security. You must keep your sign-in credentials confidential. You are responsible for all activity under your account. If you believe your account has been compromised, notify us immediately at info@mili-maus.lu.
3.4 Guardian permissions. The provider may configure your account to show specific children or specific family communications, depending on the arrangements for your family.
3.5 Children. Children do not have accounts. The provider enters and manages children's information.
4. Sessions and Bookings
4.1 Regular sessions. The provider assigns your child a regular weekly session schedule. Changes to the regular schedule are communicated by the provider.
4.2 Extra places. When extra places are available in a session, you may request one through the app. Extra places are allocated on a first-come, first-served basis and are subject to confirmation by the provider.
4.3 Confirmation. A session or extra place is confirmed when it appears with a "confirmed" status in your family space.
5. Absences and Cancellations
5.1 Reporting an absence. If your child cannot attend a scheduled session, report the absence through the app as early as possible.
5.2 Timely cancellation. An absence reported before 11:00 on the day of the session is free of charge.
5.3 Late cancellation. If you report an absence after 11:00 on the day of the session, or if your child does not attend without notice, a late-cancellation fee of €18 applies. This fee compensates the provider for the reserved place that could no longer be offered to another family.
5.4 Provider cancellations. The provider may cancel a session due to illness, public holidays or other operational reasons. You will be notified through the app. No fee is charged for sessions cancelled by the provider.
6. Pricing and Invoicing
6.1 Rate. The rate for homework-support sessions is €18 per hour. The provider may adjust the rate with at least 30 days' written notice through the app.
6.2 VAT. No VAT is charged. Invoices state the applicable exemption.
6.3 Invoices. Invoices are issued monthly and are available in your family space. Invoices are not sent by email. Each invoice lists the sessions attended, their duration and the amount due, including any late-cancellation fees.
6.4 Payment. Payment is due within 14 days of the invoice date. Accepted payment methods are communicated by the provider. No payment is processed through the app.
6.5 Late payment. If payment is not received by the due date, the provider may send a reminder through the app. If payment remains outstanding for more than 30 days after the invoice date, the provider may suspend your child's sessions and your access to the family space until the balance is settled.
6.6 Invoice disputes. If you believe an invoice is incorrect, contact the provider at info@mili-maus.lu within 14 days of the invoice date. Disputed amounts are reviewed and, if appropriate, corrected or credited on the next invoice.
7. Communications
7.1 Messages. You can exchange messages with the provider through the family space (up to 2,000 characters per message). Messages may be visible to all guardians in the family (shared conversations) or to you individually (private conversations), depending on the type.
7.2 Announcements. The provider may send announcements to all families or to selected families through the app.
7.3 Meeting requests. You can request a meeting with the provider through the app. Meetings are confirmed by the provider.
7.4 Sensitive information. Please do not include medical, health or other sensitive information in messages or meeting requests. If you need to share such information, do so in person or by other appropriate means.
7.5 Notifications. The app may send you notifications about new messages, session updates or other service-related events. You can manage your notification preferences in the app settings.
8. Your Obligations
8.1 You must provide accurate information when you create your account and keep your contact details up to date.
8.2 You must ensure your child attends scheduled sessions or report absences in accordance with section 5.
8.3 You must pay invoices by the due date.
8.4 You must use the platform respectfully. Abusive, threatening or inappropriate communications are not permitted and may result in account suspension.
9. The Provider's Obligations
9.1 The provider delivers the homework-support service with reasonable care and skill, in accordance with the agreed schedule.
9.2 The provider maintains the platform in a reasonably operational state. The provider does not guarantee uninterrupted availability and is not liable for temporary outages that do not affect the in-person service.
9.3 The provider is not responsible for the content of messages sent by other users.
10. Suspension and Termination
10.1 By you. You may end the service at any time by notifying the provider in writing (email to info@mili-maus.lu or message through the app). Any outstanding invoices remain due and payable.
10.2 By the provider. The provider may end the service or suspend your account with reasonable notice if:
- your child no longer attends sessions;
- payment is overdue for more than 30 days;
- you materially breach these terms.
In urgent cases (safety concerns, abusive conduct), the provider may suspend access immediately.
10.3 Effect of termination. When the service ends, your account is deactivated. You may request deletion of your personal data in accordance with the privacy notice. Invoices and financial records are retained for the period required by law.
11. Liability
11.1 The provider is responsible for the supervision of your child during homework-support sessions.
11.2 The provider is not liable for loss of or damage to personal belongings brought to sessions.
11.3 The provider's total liability for any claim arising from these terms or the service is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim, except where limitation is not permitted by law.
11.4 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, or for intentional misconduct or fraud.
12. Personal Data
Your personal data and your children's data are processed in accordance with:
- the family-space privacy notice at www.mili-maus.lu/privacy/; and
- the website privacy notice on www.mili-maus.lu.
13. Changes to These Terms
The provider may update these terms. Material changes will be communicated through the app at least 30 days before they take effect. Your continued use of the service after that date constitutes acceptance of the updated terms. If you do not agree with the changes, you may terminate the service under section 10.1.
14. Consumer Rights
14.1 Applicable law. These terms are governed by the laws of the Grand Duchy of Luxembourg. You benefit from any mandatory consumer-protection rules of your country of residence that cannot be overridden by agreement.
14.2 Right of withdrawal. If your service agreement was concluded at a distance (for example, entirely through the app without a prior in-person meeting), you have 14 days from the date of the agreement to withdraw without giving a reason, by sending a clear statement to info@mili-maus.lu. If you have expressly requested that sessions begin within the withdrawal period, you must pay for any sessions already delivered. The withdrawal right expires once all sessions agreed for the withdrawal period have been fully performed with your prior express consent.
14.3 Complaints. If you have a complaint about the service, write to info@mili-maus.lu. If the matter is not resolved to your satisfaction, you may refer it to:
